Immigrant Eligibility for Marketplace CMS Fact Sheet

Relevant story from a Nebraska Assister:

When enrolling a Legal Permanent Resident (LPR) within the Marketplace, there are some clients who can get Medicaid and some who fall into the 5-year Medicaid ban. Those in the “ban” are eligible for Marketplace coverage and APTC even if their income is below 100% FPL.

Often when I’m working with immigrants and ask them about their immigration status they don’t always know their correct category. For instance I worked with a lady yesterday who was age 83 and had been denied Medicaid. Her family was sure she was a refugee (and if she was, she should have gotten Medicaid). Turns out she was an IR5 (Parent of a US citizen) and therefore part of the 5-year ban (and therefore eligible for Marketplace even with $0 income).
